These Terms of Service (the "Terms") govern access to and use of ChunjoTV.com, including its websites, live-streaming functionality, video delivery systems, interfaces, applications, APIs, servers, streaming infrastructure, content delivery functionality and all related services and features (collectively, the "Service" or "ChunjoTV").

These Terms are intended to constitute a legally binding electronic agreement governed by the laws of the Republic of the Marshall Islands ("RMI"), including, where applicable, the Republic of the Marshall Islands Electronic Transactions Act 2025 and other applicable laws of the Republic.

By accessing, viewing or using the Service, or by transmitting or broadcasting content through the Service, you acknowledge that you have read, understood and agreed to these Terms.

If you do not agree to these Terms, you must not use the Service.

CHAPTER 01 / 12 · SECTIONS 1–6

The foundations

01DEFINITIONS

For purposes of these Terms:

"ChunjoTV" means the online service made available through ChunjoTV.com and the associated technical systems through which the Service is provided.

"Service" means ChunjoTV.com and all associated streaming, transmission, technical, administrative, security and related functionality.

"User" means any natural or legal person accessing or using the Service.

"Viewer" means a User who accesses, receives or watches content transmitted through the Service.

"Streamer" means any User who has been expressly granted technical permission to broadcast, transmit, upload, publish or otherwise make audiovisual content available through the Service.

"User Content" means any content selected, created, uploaded, transmitted, broadcast, displayed or otherwise made available by a User or Streamer, including:

  • live video;
  • recorded video;
  • gameplay;
  • audio;
  • music;
  • voice communications;
  • graphics;
  • text;
  • logos;
  • trademarks;
  • photographs;
  • software interfaces;
  • game assets;
  • audiovisual works;
  • overlays;
  • chat content;
  • links;
  • metadata;
  • and any other material.

"Third-Party Rights" means any right belonging to another person or entity, including copyright, related rights, neighbouring rights, trademarks, service marks, database rights, personality rights, rights of publicity, privacy rights, contractual rights, confidentiality rights or other proprietary or legal rights.

"Applicable Law" means the laws of the Republic of the Marshall Islands and, only to the extent legally unavoidable in a particular matter, any other mandatory law that a competent authority determines must apply notwithstanding the choice of RMI law contained in these Terms.

02MARSHALL ISLANDS LEGAL FRAMEWORK

These Terms are expressly intended to be governed by and interpreted under the laws of the Republic of the Marshall Islands.

Without limiting the generality of the foregoing, the Service and these Terms may be subject, where applicable, to principles arising under:

  • the Constitution of the Republic of the Marshall Islands;
  • the Electronic Transactions Act 2025;
  • the Personal Data Protection Act 2025;
  • applicable cybersecurity and cybercrime legislation of the Republic;
  • applicable contract and commercial law of the Republic;
  • applicable civil procedure and judicial legislation of the Republic;
  • and other laws, regulations and legally binding rules of the Republic of the Marshall Islands.

References to RMI law in these Terms include amendments, replacements, successor legislation and legally binding regulations made under such legislation.

Nothing in these Terms should be interpreted as voluntarily submitting ChunjoTV to a foreign legal regime merely because a Viewer accesses the Service from another country.

However, where a mandatory foreign law is determined by a court or authority having lawful jurisdiction to apply irrespective of contractual choice of law, these Terms shall not be interpreted as excluding an obligation which cannot lawfully be excluded.

03ELECTRONIC AGREEMENT

The parties expressly agree that these Terms may be formed, accepted, stored and evidenced electronically.

Accessing or using the Service after these Terms are presented or made reasonably available may constitute electronic acceptance of these Terms to the extent permitted by the laws of the Republic of the Marshall Islands.

A Streamer additionally manifests acceptance of these Terms by:

  • receiving broadcasting credentials;
  • using a Stream key;
  • accessing broadcasting functionality;
  • initiating a Stream;
  • transmitting User Content;
  • or continuing to use broadcasting functionality after the Terms become applicable.

The parties acknowledge that an agreement shall not be denied legal effect solely because it was entered into, communicated, stored or accepted electronically where RMI law provides for recognition of such electronic transactions.

Electronic logs, timestamps, account records, authentication records, server records and other electronic records may be used as evidence of access, acceptance, transmission, communication or other relevant activity to the extent permitted by applicable law.

04NATURE OF CHUNJOTV

ChunjoTV is a limited-access streaming service through which selected Streamers may transmit audiovisual content to Viewers.

Broadcasting functionality is not necessarily available to the general public.

ChunjoTV may decide which persons are permitted to broadcast.

Unless expressly stated otherwise, ChunjoTV does not operate a built-in:

  • paid subscription system;
  • advertising revenue-sharing program;
  • donation system;
  • tipping system;
  • pay-per-view system;
  • or other monetisation system for Streamers.

ChunjoTV primarily provides technical functionality enabling selected Streamers to transmit content to Viewers.

Each Streamer acts independently when determining the content of their Stream.

05NO EMPLOYMENT, PARTNERSHIP OR AGENCY

Nothing in these Terms creates:

  • an employment relationship;
  • partnership;
  • joint venture;
  • franchise;
  • fiduciary relationship;
  • principal-agent relationship;
  • representation agreement;
  • or other similar legal relationship

between ChunjoTV and a Streamer.

A Streamer is not authorised to bind ChunjoTV to any agreement or representation.

A Streamer must not represent that they are an employee, officer, legal representative or authorised agent of ChunjoTV unless expressly authorised in writing.

06LIMITED BROADCASTING ACCESS

Broadcasting through ChunjoTV is a discretionary privilege rather than an unconditional entitlement.

ChunjoTV may grant, restrict, suspend, modify or withdraw broadcasting access.

ChunjoTV may establish technical restrictions including:

  • maximum bitrate;
  • resolution;
  • frame rate;
  • bandwidth;
  • transmission protocol;
  • concurrent connection limits;
  • number of Streams;
  • Stream duration;
  • geographic availability;
  • authentication mechanisms;
  • and other technical limitations.

Broadcasting credentials are personal to the authorised Streamer unless ChunjoTV expressly permits otherwise.

CHAPTER 02 / 12 · SECTIONS 7–12

Content & responsibility

07INDEPENDENT CONTROL OF STREAM CONTENT

Each Streamer independently chooses and controls the material transmitted through their Stream.

Except for content expressly produced and published by ChunjoTV itself, ChunjoTV does not select the substantive content appearing in individual third-party Streams.

A Streamer may determine:

  • which game to play;
  • what software to display;
  • what music to play;
  • what audiovisual material to display;
  • what websites to display;
  • what persons participate in the Stream;
  • what commentary is made;
  • what graphics or overlays appear;
  • and what other material is transmitted.

Accordingly, responsibility for the Streamer's selection and transmission of User Content remains with the Streamer to the maximum extent permitted by applicable law.

08FUNDAMENTAL STREAMER RESPONSIBILITY

THE STREAMER IS RESPONSIBLE FOR THE CONTENT THAT THE STREAMER CHOOSES TO TRANSMIT.

Every Streamer is responsible for ensuring, before transmitting User Content, that the Streamer has any rights, permissions, licences, consents or other lawful basis required for that transmission.

This responsibility includes, without limitation:

  • copyright;
  • related rights;
  • neighbouring rights;
  • broadcasting rights;
  • game publishing rights;
  • audiovisual rights;
  • music rights;
  • sound recording rights;
  • performance rights;
  • trademarks;
  • logos;
  • character designs;
  • artwork;
  • software;
  • photographs;
  • video clips;
  • films;
  • television programming;
  • third-party broadcasts;
  • database rights;
  • privacy rights;
  • image rights;
  • personality rights;
  • voice recordings;
  • confidential information;
  • contractual restrictions;
  • and any other Third-Party Rights.

The technical ability to broadcast material through ChunjoTV does not mean that ChunjoTV has determined that the material may lawfully be transmitted.

09NO LICENCE FROM CHUNJOTV TO THIRD-PARTY CONTENT

ChunjoTV does not grant Streamers rights in third-party material merely because the technical Service allows such material to be transmitted.

In particular, ChunjoTV does not grant Streamers any licence to:

  • video games;
  • game clients;
  • game assets;
  • copyrighted music;
  • films;
  • television programs;
  • third-party videos;
  • trademarks;
  • software;
  • websites;
  • images;
  • sound recordings;
  • or other protected works.

Any necessary rights must be obtained independently by the Streamer.

10GAMEPLAY AND GAME-RELATED CONTENT

A Streamer transmitting gameplay is responsible for determining whether the relevant game developer, publisher, copyright owner or other rights holder permits the contemplated use.

The fact that ChunjoTV permits a Streamer technically to transmit gameplay does not constitute any representation that:

  • the game publisher authorises such streaming;
  • the Streamer's use is licensed;
  • the use qualifies for any statutory exception;
  • the game is in the public domain;
  • or the Stream does not infringe any third-party rights.

Questions relating to game footage, game music, interfaces, characters, game assets, trademarks and related material remain the responsibility of the Streamer transmitting such material.

11INCIDENTAL AND THIRD-PARTY MATERIAL

A Streamer remains responsible for material transmitted as part of their Stream even if it originates from:

  • another program;
  • another website;
  • voice chat;
  • an in-game communication system;
  • another participant;
  • a Viewer;
  • a browser window;
  • music playing in the background;
  • an overlay;
  • external software;
  • a video player;
  • or an automated process.

The Streamer should configure their broadcasting environment to avoid transmitting material they are not authorised to transmit.

12STREAMER REPRESENTATIONS

Each Streamer represents and warrants that, to the best of their knowledge:

  1. they have legal capacity to use the Service;
  2. their use of ChunjoTV is lawful;
  3. they will not knowingly transmit unlawful content;
  4. they possess, or reasonably believe they possess, any required rights relating to content they intentionally transmit;
  5. they will not knowingly misrepresent the legal status of their content;
  6. they will not falsely claim to possess a licence or authorisation;
  7. information provided in connection with a legal complaint will be materially accurate;
  8. they will reasonably cooperate with the investigation of credible complaints;
  9. they will not use ChunjoTV to intentionally facilitate criminal activity;
  10. they will not intentionally evade a suspension imposed under these Terms;
  11. they will not impersonate ChunjoTV;
  12. and they will not represent that ChunjoTV has approved or licensed third-party material unless that is expressly true.

These representations are repeated each time the Streamer broadcasts.

CHAPTER 03 / 12 · SECTIONS 13–18

Rights & permitted use

13USER CONTENT LICENCE

A Streamer retains whatever ownership rights they lawfully possess in their own User Content.

By transmitting User Content through ChunjoTV, the Streamer grants ChunjoTV a limited, non-exclusive, royalty-free licence to undertake technical acts reasonably necessary for operation of the Service, including:

  • receiving the transmission;
  • routing the transmission;
  • buffering;
  • transcoding;
  • encoding;
  • reproducing temporary technical copies;
  • generating technical previews;
  • caching;
  • distributing the transmission to Viewers;
  • delivering the transmission through content-delivery infrastructure;
  • and undertaking other technical processing required to provide the Service.

This licence exists only to the extent reasonably necessary for technical operation of ChunjoTV.

It does not transfer ownership of User Content to ChunjoTV.

14PROHIBITED USE OF THE SERVICE

Users must not knowingly use ChunjoTV to engage in unlawful activity.

Prohibited conduct may include:

  • intentionally transmitting clearly unlawful content;
  • intentionally distributing malware;
  • phishing;
  • credential theft;
  • unauthorised access;
  • exploitation of security vulnerabilities;
  • denial-of-service attacks;
  • fraudulent activity;
  • impersonation;
  • unlawful disclosure of private information;
  • sexual exploitation or abuse of children;
  • intentionally facilitating serious criminal activity;
  • unauthorised interference with the Service;
  • and deliberate circumvention of technical access controls.

ChunjoTV may restrict activity reasonably believed to violate applicable law or these Terms.

15CYBERSECURITY AND COMPUTER MISUSE

Users must not attempt to compromise the confidentiality, integrity, availability or security of ChunjoTV systems.

Without limitation, Users must not:

  • obtain unauthorised access;
  • probe systems without permission;
  • exploit vulnerabilities;
  • introduce malware;
  • intercept credentials;
  • steal Stream keys;
  • circumvent authentication;
  • interfere with network operations;
  • conduct DDoS attacks;
  • manipulate logs;
  • access another Streamer's account without permission;
  • or intentionally damage computer systems.

ChunjoTV reserves the right to preserve relevant electronic evidence and cooperate with legally valid proceedings where suspected cybercrime or serious computer misuse occurs.

Nothing in these Terms authorises activity prohibited by applicable cybersecurity or cybercrime law of the Republic of the Marshall Islands.

16NO GENERAL MONITORING OBLIGATION CREATED BY THESE TERMS

ChunjoTV may use moderation, security, automated detection, manual review or other mechanisms at its discretion.

However, nothing in these Terms constitutes a contractual undertaking by ChunjoTV to continuously monitor every Stream or proactively identify every possible legal violation.

Live Streams occur in real time and may change continuously.

ChunjoTV may therefore become aware of particular material only after:

  • receiving a report;
  • receiving a legal notice;
  • detecting a technical event;
  • reviewing a Stream;
  • or otherwise obtaining actual information concerning the material.

17NO ENDORSEMENT

The availability of a Stream through ChunjoTV does not mean that ChunjoTV:

  • endorses the Streamer;
  • endorses statements made by the Streamer;
  • owns the Stream;
  • sponsors the Stream;
  • verifies the Stream;
  • has reviewed all material in the Stream;
  • has verified all licences;
  • or guarantees the legality of the Stream.

Similarly, failure to remove a Stream does not constitute a legal determination that the Stream is lawful.

18INTELLECTUAL PROPERTY COMPLAINTS

ChunjoTV respects intellectual property rights and provides a mechanism through which complaints regarding specific User Content may be submitted.

Copyright, trademark or other intellectual-property reports should be sent to:

[email protected]

Where reasonably possible, the email subject should identify the complaint, for example:

Copyright Complaint – [Streamer Name / Stream URL]

A complaint should contain enough information for the relevant material and alleged right to be meaningfully identified.

CHAPTER 04 / 12 · SECTIONS 19–24

Complaints & resolution

19INFORMATION REQUIRED IN A RIGHTS COMPLAINT

A rights complaint should, where applicable, contain:

  1. the complainant's full name;
  2. the complainant's organisation, if applicable;
  3. reliable contact information;
  4. identification of the rights holder;
  5. an explanation of the complainant's authority to act for the rights holder, if applicable;
  6. identification of the copyrighted work, trademark or other protected matter;
  7. identification of the particular allegedly infringing material;
  8. the Stream URL or other location;
  9. the relevant Streamer's name, if known;
  10. the date and approximate time of the alleged infringement;
  11. a reasonably detailed explanation of the alleged violation;
  12. supporting evidence reasonably available to the complainant;
  13. any relevant registration or licensing information;
  14. and confirmation that the information supplied is, to the complainant's knowledge, materially accurate.

Merely stating that "this Stream violates copyright" without identifying the protected work and allegedly infringing material may be insufficient to permit meaningful evaluation.

20INCOMPLETE COMPLAINTS

If a complaint lacks sufficient information, ChunjoTV may request clarification or additional documentation before determining whether action is appropriate.

ChunjoTV may request:

  • evidence of ownership;
  • evidence of authority;
  • exact timestamps;
  • specific URLs;
  • screenshots;
  • identification of protected works;
  • explanations of the alleged infringement;
  • or other relevant information.

A request for further information does not constitute acceptance or rejection of the complaint.

21HANDLING OF COMPLAINTS

Upon receiving a sufficiently specific complaint, ChunjoTV may take any action it reasonably considers appropriate under the circumstances and applicable law.

Possible action includes:

  • requesting more information;
  • preserving relevant technical records;
  • forwarding the complaint to the Streamer;
  • requesting a response;
  • requesting evidence of permission;
  • restricting specific content;
  • temporarily interrupting a Stream;
  • disabling a Stream;
  • suspending broadcasting access;
  • terminating broadcasting access;
  • taking no immediate action pending further information;
  • facilitating communication between the parties;
  • or complying with a valid order from a competent authority.

ChunjoTV may consider the credibility, specificity, seriousness and evidentiary basis of a complaint.

22NO AUTOMATIC PRESUMPTION FROM A COMPLAINT

A complaint is an allegation.

The mere fact that a complaint has been submitted does not automatically establish:

  • infringement;
  • illegality;
  • ownership;
  • liability;
  • bad faith;
  • or any other legal conclusion.

Where a genuine dispute exists, ChunjoTV may seek information from both sides before deciding what voluntary platform action is appropriate.

Nothing in this provision restricts ChunjoTV from taking immediate temporary action where reasonably necessary to prevent serious legal, technical or security harm.

23DIRECT RESOLUTION WITH THE STREAMER

User Content is selected and transmitted by individual Streamers.

Accordingly, where appropriate, a rights dispute concerning specific User Content may be resolved directly between the complainant and the Streamer responsible for transmitting that material.

ChunjoTV may facilitate such communication.

The parties acknowledge that ChunjoTV is not required to act as a court, tribunal or private arbitrator for complex copyright, licensing, ownership or contractual disputes.

24STREAMER LEGAL CONTACT

A Streamer may be required to provide ChunjoTV with a designated email address or other contact method for legal, copyright and rights-enforcement matters.

By accepting broadcasting access, the Streamer acknowledges and agrees that this designated contact information may, subject to applicable law, be provided to a bona fide complainant whose claim relates specifically to that Streamer's User Content.

The purpose of such disclosure is to enable direct communication concerning the dispute.

Streamers are encouraged to provide a dedicated business or legal contact rather than a private residential contact.

CHAPTER 05 / 12 · SECTIONS 25–30

Privacy & responses

25DISCLOSURE OF STREAMER CONTACT DETAILS

Subject to the laws of the Republic of the Marshall Islands, including applicable personal-data protection requirements, ChunjoTV may provide a complainant with the Streamer's designated legal or rights-enforcement contact details where reasonably necessary for resolution of a bona fide claim concerning that Streamer's User Content.

Such disclosure does not constitute:

  • admission of infringement;
  • endorsement of the complaint;
  • legal representation of the complainant;
  • legal representation of the Streamer;
  • or acceptance of liability by ChunjoTV.

ChunjoTV does not promise to provide unrestricted personal information merely because someone submits a complaint.

26OTHER PERSONAL INFORMATION

Personal, account or technical information beyond the Streamer's designated legal contact information may be disclosed only where there is a lawful basis for doing so.

Such circumstances may include, where applicable:

  • consent;
  • performance or enforcement of these Terms;
  • establishment, exercise or defence of legal claims;
  • compliance with RMI law;
  • compliance with a valid order issued by a competent RMI court or authority;
  • compliance with other legally binding process recognised under applicable law;
  • protection against fraud or serious abuse;
  • or another lawful basis recognised by applicable data-protection law.

Nothing in these Terms requires ChunjoTV voluntarily to disclose information where disclosure would be unlawful.

27PERSONAL DATA PROTECTION

Where the Republic of the Marshall Islands Personal Data Protection Act 2025 applies, ChunjoTV intends to process personal data consistently with applicable obligations under that Act.

Personal data processed through the Service may include, where applicable:

  • email addresses;
  • IP addresses;
  • account identifiers;
  • Streamer identifiers;
  • authentication information;
  • network information;
  • user-agent information;
  • timestamps;
  • security logs;
  • connection logs;
  • Stream metadata;
  • complaint correspondence;
  • and related technical information.

Such data may be processed where reasonably necessary for:

  • providing the Service;
  • authenticating users;
  • protecting the Service;
  • preventing abuse;
  • administering Streamer access;
  • responding to complaints;
  • investigating security incidents;
  • establishing or defending legal claims;
  • complying with legal obligations;
  • and maintaining technical operations.

Where legally required, additional information concerning personal-data processing may be provided through a separate privacy notice.

28STREAMER RESPONSE TO COMPLAINTS

Where ChunjoTV forwards a complaint to a Streamer, the Streamer should review it promptly.

The Streamer may respond with information including:

  • proof of ownership;
  • proof of licence;
  • written permission;
  • contractual permission;
  • clarification concerning the content;
  • evidence that the wrong Stream was identified;
  • an explanation of the relevant use;
  • evidence of an applicable exception or defence;
  • or confirmation that the material will no longer be transmitted.

The Streamer is responsible for ensuring that any response is materially accurate.

29DISPUTED CLAIMS

ChunjoTV may determine that a complaint presents a genuine dispute between private parties that cannot reasonably be resolved by the Service.

In such circumstances, ChunjoTV may:

  • maintain a temporary restriction;
  • restore functionality;
  • request further evidence;
  • refer the parties to direct communication;
  • invite the complainant to obtain appropriate legal relief;
  • or otherwise act reasonably based upon the circumstances.

Nothing in these Terms requires ChunjoTV to adjudicate complicated questions of copyright ownership or licensing.

30FALSE OR ABUSIVE REPORTS

Users must not knowingly submit fraudulent, intentionally misleading or abusive complaints.

This includes complaints made primarily to:

  • harass another person;
  • impersonate a rights holder;
  • suppress lawful content through knowingly false allegations;
  • obtain unrelated personal information;
  • identify confidential infrastructure;
  • disrupt ChunjoTV;
  • interfere with another Streamer;
  • or misuse the reporting process.

ChunjoTV may disregard reports reasonably considered fraudulent, abusive or manifestly deficient.

Where permitted by law, information concerning serious abuse of the reporting system may be preserved or disclosed for the establishment, exercise or defence of legal claims.

CHAPTER 06 / 12 · SECTIONS 31–36

Access & liability

31REPEAT INFRINGEMENT AND SERIOUS VIOLATIONS

ChunjoTV may restrict, suspend or terminate a Streamer's broadcasting privileges where the Streamer repeatedly or seriously violates these Terms, applicable law or Third-Party Rights.

Relevant factors may include:

  • number of credible complaints;
  • seriousness of the alleged infringement;
  • repeated similar conduct;
  • previous warnings;
  • evidence submitted by rights holders;
  • responses submitted by the Streamer;
  • whether previous complaints were shown to be incorrect;
  • and legal risks associated with continued transmission.

No particular number of reports automatically establishes infringement.

32NO GUARANTEED RIGHT TO CONTINUE STREAMING

ChunjoTV is under no contractual obligation to continue broadcasting any particular Stream indefinitely.

To the extent permitted under RMI law, ChunjoTV may restrict or suspend broadcasting for reasons including:

  • breach of these Terms;
  • legal compliance;
  • credible intellectual-property complaints;
  • security;
  • technical failures;
  • network stability;
  • hosting restrictions;
  • infrastructure-provider requirements;
  • maintenance;
  • abuse prevention;
  • or discontinuation of the Service.

33STREAMER INDEMNIFICATION

To the maximum extent permitted under the laws of the Republic of the Marshall Islands, each Streamer agrees to indemnify, defend and hold harmless ChunjoTV and persons involved in administering, maintaining or technically supplying the Service from third-party claims, liabilities, losses, damages, judgments, settlements, penalties and reasonable legal expenses arising from or relating to:

  • the Streamer's User Content;
  • the Streamer's decision to transmit particular material;
  • allegations that the Streamer's User Content infringes Third-Party Rights;
  • breach of these Terms;
  • breach of applicable law;
  • false representations made by the Streamer;
  • unauthorised use of protected material;
  • or misuse of credentials controlled by the Streamer.

This provision applies only to the extent legally enforceable under applicable RMI law.

Nothing in this section requires indemnification for liability which applicable law does not permit to be transferred or excluded.

34THIRD-PARTY CLAIMS AGAINST CHUNJOTV

Where a third-party claim arises primarily from content selected and transmitted by a Streamer, the Streamer acknowledges that ChunjoTV may:

  • notify the Streamer;
  • forward relevant correspondence;
  • require information concerning the Stream;
  • preserve relevant electronic records;
  • restrict the Stream;
  • and request reasonable cooperation from the Streamer.

The Streamer remains responsible for their own legal defence and should obtain independent legal advice where necessary.

35LIMITATION OF LIABILITY

To the maximum extent permitted by the laws of the Republic of the Marshall Islands, the Service is provided "AS IS" and "AS AVAILABLE."

ChunjoTV does not warrant that the Service will:

  • operate without interruption;
  • remain available permanently;
  • be error-free;
  • provide any minimum uptime;
  • preserve every transmission;
  • operate at any guaranteed bitrate;
  • have any particular latency;
  • prevent every cyberattack;
  • prevent every unauthorised access attempt;
  • or remain compatible with every device or software configuration.

To the maximum extent permitted under RMI law, ChunjoTV shall not be liable for indirect, incidental, consequential, exemplary, special or punitive damages relating to use of the Service.

This may include, where legally permitted:

  • loss of data;
  • loss of audience;
  • loss of opportunity;
  • reputational loss;
  • interruption of a Stream;
  • lost anticipated revenue;
  • or other consequential losses.

Nothing in these Terms excludes liability to the extent RMI law expressly prohibits such exclusion.

36USER ASSUMPTION OF TECHNICAL RISK

The internet and live-streaming technologies are inherently subject to technical interruptions.

Users acknowledge that:

  • Streams can disconnect;
  • packets can be lost;
  • video quality can decrease;
  • upstream networks can fail;
  • servers can fail;
  • CDN providers can fail;
  • DNS providers can fail;
  • network attacks can occur;
  • and maintenance may require downtime.

ChunjoTV does not guarantee uninterrupted availability.

CHAPTER 07 / 12 · SECTIONS 37–42

Infrastructure & security

37THIRD-PARTY INFRASTRUCTURE

ChunjoTV may rely upon third-party providers including:

  • hosting providers;
  • data centres;
  • network carriers;
  • transit providers;
  • CDN providers;
  • DNS providers;
  • software vendors;
  • security providers;
  • domain registrars;
  • telecommunications services;
  • storage providers;
  • and other infrastructure providers.

ChunjoTV cannot guarantee the conduct or uninterrupted performance of independently operated third-party systems.

38NO LIABILITY FOR THIRD-PARTY CONDUCT

To the maximum extent permitted by RMI law, ChunjoTV is not responsible merely by reason of operating the Service for:

  • statements made by Streamers;
  • private agreements entered into by Streamers;
  • external websites displayed by Streamers;
  • purchases made outside ChunjoTV;
  • conduct occurring outside the Service;
  • or representations independently made by Streamers.

Nothing in this clause excludes a liability which applicable law directly imposes upon ChunjoTV and does not permit to be excluded.

39TECHNICAL LOGS AND ELECTRONIC RECORDS

ChunjoTV may maintain electronic records reasonably necessary for operation and security.

Such records may include:

  • IP addresses;
  • Stream identifiers;
  • authentication events;
  • Stream keys or hashed identifiers;
  • connection times;
  • disconnection times;
  • timestamps;
  • traffic information;
  • server logs;
  • security alerts;
  • bandwidth information;
  • user-agent information;
  • and complaint correspondence.

Electronic records may be retained or relied upon where relevant to:

  • administration;
  • cybersecurity;
  • fraud prevention;
  • complaint investigation;
  • contractual enforcement;
  • legal claims;
  • or legal compliance.

Such electronic records may be used as evidence to the extent permitted under the laws and evidentiary rules applicable in the Republic of the Marshall Islands.

40SECURITY INCIDENTS

ChunjoTV may investigate actual or suspected security incidents.

Where reasonably necessary and legally permissible, ChunjoTV may:

  • restrict access;
  • rotate Stream keys;
  • invalidate credentials;
  • block connections;
  • preserve logs;
  • investigate technical events;
  • or notify appropriate authorities.

A User must not interfere with a legitimate security investigation.

41STREAM KEYS AND CREDENTIALS

Streamers must protect Stream keys and other credentials from unauthorised access.

Streamers must not knowingly provide broadcasting credentials to unauthorised third parties.

Where ChunjoTV reasonably believes credentials are compromised, it may:

  • invalidate them;
  • replace them;
  • suspend them;
  • or require reauthentication.

The Streamer should promptly report suspected unauthorised use.

42LEGAL REQUESTS AND COURT ORDERS

ChunjoTV may respond to legally binding requests issued by competent courts or authorities.

Where appropriate and permitted, ChunjoTV may evaluate whether a request:

  • appears authentic;
  • is directed to information under its control;
  • is legally binding;
  • is sufficiently specific;
  • and complies with applicable procedural requirements.

Nothing in these Terms constitutes a voluntary waiver of any right to challenge or object to an invalid, excessive or legally defective request.

CHAPTER 08 / 12 · SECTIONS 43–48

Legal process & moderation

43MARSHALL ISLANDS LEGAL PROCESS

Where legal process originates in the Republic of the Marshall Islands, ChunjoTV may respond in accordance with applicable RMI law, including applicable court rules and procedural requirements.

Foreign judgments, subpoenas, demands or other legal instruments shall not automatically be treated as equivalent to an order issued by an RMI court merely because they originate from a foreign jurisdiction.

Any recognition or enforcement of foreign legal process shall be determined according to applicable law, international arrangements and legally binding procedures.

Nothing herein prevents voluntary lawful cooperation where ChunjoTV determines such cooperation is appropriate.

44PRESERVATION OF EVIDENCE

Where reasonably necessary for an actual or reasonably anticipated dispute, investigation or legal proceeding, ChunjoTV may preserve relevant records for an appropriate period.

Preservation does not imply that:

  • a claim is valid;
  • wrongdoing occurred;
  • liability is admitted;
  • or information will necessarily be disclosed.

Disclosure remains subject to applicable law.

45MODERATION

ChunjoTV may moderate the Service where reasonably necessary.

Moderation decisions may be based upon:

  • these Terms;
  • RMI law;
  • security requirements;
  • technical limitations;
  • credible reports;
  • infrastructure-provider requirements;
  • or protection of the Service.

A moderation decision is not necessarily a legal judgment concerning whether the underlying User Content is lawful.

46NO LEGAL REPRESENTATION

ChunjoTV does not act as:

  • attorney;
  • legal adviser;
  • copyright agent;
  • litigation representative;
  • or legal representative

for either a Streamer or complainant.

Facilitating communication between the parties does not create an attorney-client, fiduciary or agency relationship.

Each party remains responsible for obtaining independent legal advice.

47NO TRANSFER OF CONTENT RESPONSIBILITY

Technical transmission of User Content through ChunjoTV does not itself transfer authorship, ownership or control of that User Content to ChunjoTV.

As between ChunjoTV and the Streamer, the Streamer remains responsible for:

  • selecting the content;
  • choosing to transmit it;
  • obtaining required permissions;
  • and responding to claims concerning the Streamer's transmission,

to the maximum extent permitted by RMI law.

This provision does not purport to exclude any non-waivable liability imposed directly upon ChunjoTV under applicable law.

48COPYRIGHT STATUS NOT DETERMINED BY CHUNJOTV

Copyright issues may involve:

  • ownership;
  • licences;
  • contractual rights;
  • territorial limitations;
  • statutory exceptions;
  • implied permissions;
  • factual disputes;
  • and choice-of-law questions.

ChunjoTV therefore does not guarantee that any particular use is:

  • licensed;
  • unlicensed;
  • infringing;
  • non-infringing;
  • permitted;
  • prohibited;
  • fair use;
  • public domain;
  • parody;
  • quotation;
  • criticism;
  • commentary;
  • or otherwise subject to a particular exception.

Such questions may ultimately need to be determined between the relevant parties or by a competent legal authority.

CHAPTER 09 / 12 · SECTIONS 49–54

Changes & communication

49TERMINATION BY STREAMER

A Streamer may stop using ChunjoTV at any time.

Termination does not eliminate obligations arising from prior conduct.

Provisions which by their nature should survive termination shall continue to apply, including provisions relating to:

  • intellectual property;
  • indemnification;
  • limitation of liability;
  • disputes;
  • evidence;
  • governing law;
  • jurisdiction;
  • and legal claims.

50SUSPENSION OR TERMINATION BY CHUNJOTV

To the maximum extent permitted by RMI law, ChunjoTV may suspend or terminate access where reasonably appropriate.

Possible reasons include:

  • breach of these Terms;
  • security concerns;
  • misuse;
  • repeated credible complaints;
  • unlawful activity;
  • legal obligations;
  • compromised credentials;
  • infrastructure restrictions;
  • technical necessity;
  • or discontinuation of the Service.

Immediate action may be taken where delay could create material harm.

51DISCONTINUATION OF THE SERVICE

ChunjoTV does not guarantee that the Service will operate indefinitely.

The Service, or any portion of it, may be:

  • modified;
  • migrated;
  • suspended;
  • restructured;
  • transferred;
  • or discontinued.

No User acquires a permanent right to continuation of any particular feature.

52CHANGES TO THESE TERMS

These Terms may be modified periodically.

The current version may be published through ChunjoTV.com.

Where required under applicable law, material amendments may be communicated through an appropriate electronic mechanism.

Continued use following the effective date of revised Terms constitutes acceptance to the extent recognised by applicable RMI law.

A User who does not accept amended Terms must discontinue use.

53ELECTRONIC COMMUNICATIONS

Users agree that communications concerning the Service may be sent electronically.

Such communications may include:

  • notices;
  • complaints;
  • responses;
  • security notifications;
  • policy updates;
  • access notifications;
  • and other Service-related communications.

To the extent permitted under the RMI Electronic Transactions Act 2025 and other applicable law, electronic communications and electronic records may satisfy requirements that information be provided or retained in writing.

54LEGAL AND COPYRIGHT CONTACT

Legal notices, copyright complaints, trademark complaints, rights-enforcement requests and other legal communications concerning ChunjoTV may be submitted to:

[email protected]

Where the communication concerns specific User Content, the sender should include:

  • Streamer name;
  • Stream URL;
  • date;
  • approximate time;
  • description of the content;
  • legal basis of the complaint;
  • identification of the relevant rights;
  • and supporting documentation where appropriate.

ChunjoTV may request further information before determining whether action is required.

CHAPTER 10 / 12 · SECTIONS 55–60

Governing law & jurisdiction

55SERVICE OF ORDINARY PLATFORM COMMUNICATIONS

The email address specified in Section 54 is intended for ordinary legal correspondence, copyright reports and Service-related notices.

The publication of an email address does not by itself constitute consent to any method of formal judicial service that is not otherwise valid under applicable procedural law.

Formal service of court proceedings must comply with applicable legal requirements.

56GOVERNING LAW

These Terms, their formation, existence, interpretation, validity, performance, enforcement and termination, and any contractual or non-contractual dispute arising out of or relating to these Terms or the Service, shall be governed by and construed in accordance with the laws of the Republic of the Marshall Islands, without regard to conflict-of-laws principles that would require application of the laws of another jurisdiction.

The parties expressly select the laws of the Republic of the Marshall Islands as the governing law of their contractual relationship relating to the Service.

To the extent a question is not expressly governed by written legislation of the Republic of the Marshall Islands, the matter shall be determined according to legal principles recognised and applicable in the Republic of the Marshall Islands.

Nothing in this provision excludes any mandatory rule that a competent court determines cannot lawfully be displaced by contractual choice of law.

57EXCLUSIVE JURISDICTION

To the maximum extent permitted by applicable law, any dispute, claim, action or proceeding arising out of or relating to:

  • these Terms;
  • the Service;
  • access to ChunjoTV;
  • broadcasting through ChunjoTV;
  • contractual obligations concerning ChunjoTV;
  • or the interpretation or enforcement of these Terms

shall be subject to the jurisdiction of the courts of the Republic of the Marshall Islands.

Where the High Court of the Republic of the Marshall Islands has subject-matter and personal jurisdiction over the dispute, the parties agree, to the maximum extent legally permissible, to submit to that court.

Nothing in this section purports to confer subject-matter jurisdiction upon a court where jurisdiction does not otherwise exist under RMI law.

58VENUE

To the maximum extent permitted under RMI law, proceedings concerning these Terms should be brought in the Republic of the Marshall Islands.

The parties agree not to object to an otherwise legally proper RMI forum merely because another jurisdiction might also be available or more convenient.

This provision remains subject to mandatory jurisdictional rules that cannot legally be waived.

59RMI COURT AUTHORITY

The parties acknowledge that the judicial authority of the Republic of the Marshall Islands is exercised through the courts established under the Constitution and laws of the Republic.

Nothing in these Terms limits the authority of an RMI court to:

  • interpret these Terms;
  • determine its own jurisdiction;
  • issue lawful orders;
  • apply mandatory legislation;
  • or provide remedies within its lawful authority.

60CONFLICT OF LAWS

The parties intend the express choice of Republic of the Marshall Islands law contained in these Terms to be given maximum lawful effect.

A User's temporary or permanent presence in another country does not, by itself, amend the governing-law agreement contained in these Terms.

If a court determines that a particular mandatory provision of foreign law nevertheless applies, that provision shall apply only to the extent legally required and shall not otherwise alter the parties' selection of RMI law.

CHAPTER 11 / 12 · SECTIONS 61–66

General provisions

61SEVERABILITY

If any provision of these Terms is held unlawful, invalid or unenforceable under applicable law, that provision shall, where legally possible, be construed or modified to the minimum extent necessary to make it enforceable.

Where modification is not possible, the affected provision shall be severed.

The remainder of these Terms shall continue in effect.

The parties intend this severability provision to be applied to preserve the maximum lawful effect of these Terms under RMI law.

62NO WAIVER

Failure to enforce a provision does not constitute waiver of the right to enforce that provision later.

A waiver of one breach does not constitute waiver of another breach.

Any waiver must be interpreted narrowly.

63ASSIGNMENT AND TRANSFER

To the extent permitted by applicable law, Users may not assign rights under these Terms without prior permission.

ChunjoTV may transfer, reorganise or migrate the Service or contractual arrangements relating to the Service as part of a legitimate:

  • restructuring;
  • transfer;
  • migration;
  • technical reorganisation;
  • or change in administration.

Any such transfer remains subject to applicable legal obligations.

64FORCE MAJEURE

To the maximum extent permitted by RMI law, ChunjoTV shall not be responsible for delay or failure caused by circumstances reasonably beyond its control.

Examples include:

  • natural disasters;
  • typhoons;
  • floods;
  • earthquakes;
  • fire;
  • power failures;
  • undersea cable failures;
  • telecommunications interruptions;
  • internet outages;
  • war;
  • civil unrest;
  • governmental action;
  • sanctions;
  • cyberattacks;
  • DDoS attacks;
  • data-centre failures;
  • CDN failures;
  • upstream-provider failures;
  • domain or DNS failures;
  • or other events beyond reasonable control.

65ENTIRE AGREEMENT

These Terms constitute the general agreement governing access to and use of ChunjoTV unless additional written terms expressly apply.

No oral statement or informal communication modifies these Terms unless legally effective and expressly intended to do so.

66INTERPRETATION

Headings are provided for convenience only.

Unless the context requires otherwise:

  • singular includes plural;
  • plural includes singular;
  • "including" means "including without limitation";
  • references to legislation include amendments and successor legislation;
  • references to writing include electronic records where legally recognised;
  • and references to persons may include legal entities where appropriate.

These Terms should be interpreted to give lawful effect to the parties' intentions rather than to invalidate an otherwise lawful provision.

CHAPTER 12 / 12 · SECTIONS 67–72

Language & acknowledgement

67LANGUAGE

These Terms are written in English.

Translations may be provided for convenience.

Where legally permissible and where there is an inconsistency between an unofficial translation and the English version, the English version shall prevail.

68NO THIRD-PARTY BENEFICIARY RIGHTS

Except where these Terms expressly state otherwise or applicable law requires otherwise, no third party acquires contractual rights under these Terms merely because they are referred to in them.

69SURVIVAL

The following provisions, together with any other provisions which by their nature should survive, shall remain applicable after termination of access to the Service:

  • Streamer responsibility;
  • intellectual-property provisions;
  • complaint provisions;
  • data and evidence provisions where lawfully applicable;
  • indemnification;
  • limitation of liability;
  • governing law;
  • jurisdiction;
  • venue;
  • interpretation;
  • severability;
  • and dispute-related provisions.

(B) THE STREAMER IS RESPONSIBLE FOR DETERMINING WHETHER THE STREAMER HAS THE RIGHTS NECESSARY TO TRANSMIT SUCH CONTENT;

(G) CHUNJOTV MAY TEMPORARILY OR PERMANENTLY RESTRICT A STREAM WHERE REASONABLY NECESSARY;

(H) THE FACT THAT CHUNJOTV DOES NOT IMMEDIATELY REMOVE A STREAM DOES NOT CONSTITUTE A LEGAL DETERMINATION THAT THE STREAM IS LAWFUL;

(I) THE FACT THAT CHUNJOTV REMOVES OR RESTRICTS A STREAM DOES NOT NECESSARILY CONSTITUTE A LEGAL DETERMINATION THAT THE STREAM WAS UNLAWFUL;

(J) AS BETWEEN CHUNJOTV AND THE STREAMER, THE STREAMER REMAINS RESPONSIBLE FOR THE STREAMER'S OWN SELECTION AND TRANSMISSION OF USER CONTENT TO THE MAXIMUM EXTENT PERMITTED UNDER RMI LAW;

AND

(K) THESE TERMS ARE GOVERNED BY THE LAWS OF THE REPUBLIC OF THE MARSHALL ISLANDS AS PROVIDED HEREIN.
